Higenda provides a software platform designed to assist businesses with scheduling and booking management. We commit to maintaining the availability and functionality of our Services during the periods for which they have been paid and contracted. Our Services are provided on an 'as-is' basis during these contracted periods. While we strive to provide continuous service, Higenda cannot guarantee uninterrupted access at all times.
HIGENDA SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, EVEN IF HIGENDA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This includes, but is not limited to, damages resulting from: (a) errors or omissions in our software; (b) loss of data or business interruption; (c) unauthorized access to or use of our Services; (d) third-party actions or content; or (e) any other matter relating to our Services. Our total liability under these Terms shall not exceed the amount you have paid to Higenda in the twelve months preceding the claim.
While Higenda is committed to providing high-quality software, we acknowledge that errors can occur in any software system. We maintain reasonable efforts to identify and correct errors through our quality assurance processes. However, Higenda does not warrant that our Services will be error-free or uninterrupted. Users are advised to maintain regular backups of their data and to test our Services thoroughly before relying on them for critical business functions.
Although Higenda maintains measures to protect your data, we strongly recommend that users maintain independent backups of all critical data. In the event that you require a backup or recovery of your data, please contact us at higenda.app@gmail.com with your request. We will work to assist you during normal business hours. However, Higenda is not liable for any data loss or recovery delays that may occur.
Higenda operates on robust infrastructure designed for reliability; however, server issues, outages, or technical failures can occur. These may be due to factors beyond our control, including but not limited to internet service provider issues, third-party service failures, or unforeseen circumstances. Higenda shall not be liable for damages resulting from server problems, downtime, or infrastructure failures, regardless of the cause.
Our Services may integrate with or rely upon third-party services and providers. Higenda is not responsible for the availability, performance, or security of third-party services. Any claims or issues arising from third-party services should be directed to the respective service providers.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not engage in any activity that interferes with or disrupts the normal functioning of our Services.

These Terms shall be governed by and construed in accordance with applicable international law and the laws of the jurisdictions in which Higenda operates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the appropriate courts.
These Terms, together with any applicable service agreements, constitute the entire agreement between you and Higenda concerning the use of our Services and supersede all prior agreements and understandings.
